General Data Protection Regulations (GDPR) – Also in Switzerland.

The European General Data Protection Regulation (GDPR) came into effect in May 2018. At first glance, this doesn’t seem to affect Swiss companies, but, in fact, this is only partly true.


Swiss businesses are obliged to comply with the GDPR if:

  • Personal data is collected or processed in a European branch or subsidiary
  • A processor is located within the EU
  • The personal data of EU customers is collected (e.g. newsletter e-mail addresses)


It’s important to note that, even if a Swiss business does not make its offerings available for the EU, but an EU user is tracked by a tracking tool, the GDPR will ‘probably’ apply In other words, even Swiss companies are going to have to get to grips with the GDPR.

What are the new GDPR requirements?

It is not yet clear what the complete spectrum of requirements looks like, because many have yet to be developed. However, the regulation has laid down a number of crucial requirements:

  • Data Protection by Design and Data Protection by Default
  • Pseudonymisation and encryption of personal data
  • Appointment of a data protection officer who monitors compliance with the regulations
  • Introduction and implementation of suitable guidelines and processes (to demonstrate GDPR compliance)
  • Informing the supervisory authorities of a violation of the protection of personal data within 24 hours
  • Prevention of unauthorised access to personal data
